Terms of Service
Welcome to FITBODY! These Terms of Service govern your use of our websites, applications, content, products, and services. By accessing or using FITBODY’s services, you agree to the terms outlined below. If you do not agree, please refrain from using our services.
Company Information
FITBODY and its associated entities, including Lohre Studios, LLC, ("FITBODY," "we," "us," or "our") provide health, fitness, nutrition, and lifestyle services, along with related products. By using our website or placing an order, you acknowledge that you have read, understood, and agree to these Terms of Service.
Payment
- We accept Visa, Mastercard, Discover, American Express, Apple Pay, and Shop Pay for secure and convenient transactions.
- Sales Tax: We charge local sales tax for orders and services shipped/delivered within our home state of Kentucky, as required by law.
Order Acceptance Policy
- The receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.
- We reserve the right to accept or decline your order for any reason.
- If an order cannot be fulfilled as requested, we will contact you to discuss alternatives or process a cancellation.
Order Processing and Shipping
- Processing Times: Orders are processed within 1-3 business days, provided all items are in stock. Orders placed after 2:00 PM ET on Fridays or during holidays may be processed the next business day.
- Shipping Options: Shipping methods include Flat Rate Shipping, UPS® Ground, USPS Ground Advantage, USPS Priority Mail, and USPS Priority Mail Express.
- Delivery timelines outlined during checkout and on our Shipping Policy Page are estimates and may vary due to weather, carrier delays, or unforeseen circumstances.
- Once a package is handed off to the carrier, FITBODY is not responsible for delays, mis-delivery, theft, or loss caused by the carrier.
Shipping Liability and Address Accuracy
- Customer Responsibility for Address Accuracy: Customers are responsible for providing accurate and complete shipping addresses at checkout. Packages returned to us due to incorrect or incomplete addresses will require additional shipping fees for reshipment. If no updated address is provided within 10 days, the order will be canceled.
- Delivery Issues: If a package is marked as delivered but not received, the customer must contact the carrier directly to resolve the issue. We will assist by providing tracking information but are not responsible for theft or mis-delivery.
Sale Information
- We occasionally have sales on products, such as FITBODY VIP Sales, Black Friday, Flash Sales or Holiday Sales. These discounts apply only during the specific times mentioned on our website, emails, or other communications.
- For subscriptions, the sale price applies only to the order placed or renewed during the sale period. All future orders under the subscription will be charged at the current pricing on the site at the time the subsequent order is placed, with the standard subscription discount applied. Please note, subscriptions require a minimum of two deliveries to qualify for the discounted pricing. No cancellation may occur until after 2 fulfillments.
- Subscription prices may be adjusted from time to time based on sitewide sales, price changes, or product updates. Any price adjustments will reflect the subscription discount applied to the current product price at the time of reorder. Coupon code-based discounts are not eligible to be used on subscriptions.
OUT OF STOCK PRODUCTS
We will ship your product as it becomes available if it is out of stock. Usually, products ship within 1-3 business days, or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major holiday.
However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will do our best to keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.
Returns, Refunds, and Cancellations
- For details on returns and cancellations, please refer to our Refund Policy.
- Digital downloads are non-refundable. If you experience technical issues, contact us for assistance within 14 days of purchase.
- Orders may be canceled if incorrect or incomplete information is provided during checkout. A cancellation fee may apply if the order has already been processed or shipped.
Lost, Delayed, or Damaged Shipments
- Lost or Damaged Shipments: Contact us within 7 business days after the longest expected delivery date timing for assistance with filing a claim. Depending on the outcome of the carrier’s investigation, we may reship the order.
- Weather-Related Delays: Severe weather conditions or other disruptions may delay shipments. These circumstances are beyond our control, and customers should allow additional time for delivery.
International Shipping
- FITBODY does not currently ship to addresses outside of the United States with the exception of APO and Military Bases supported by domestic shipping rates.
Digital Downloads
- Digital downloads are valid for 14 days from the date of purchase. Please download and save files immediately to avoid losing access.
- Technical Issues: If you encounter issues downloading your product, email us for assistance at shop@fitbody.com. Ensure your device and browser settings allow for downloads.
- There are no refunds on downloadable products. No exceptions. If you have any problems downloading, contact us as soon as possible so we can remedy the issue.
Troubleshooting Digital Downloads
- Check Your Email Confirmation: Ensure you received the email with the download link. If not, check your spam or junk folder.
- Find Saved Files: If you accessed the download page but the link didn’t open, your browser may have automatically saved the file to your “Downloads” folder or another default location.
- Disable Pop-Up Blockers: If the download isn’t working, check your browser settings for pop-up blockers and disable them temporarily.
- Workplace or Institution Restrictions: Some networks may block downloads. If you’re on a restricted network, try downloading from a different device or location.

Q: Are you downloading on a computer?
A: Files are designed for download and saving on a computer. While they may be viewable on tablets or phones, some devices require additional steps to save files. We recommend downloading to a computer and syncing to your device if needed.
Q: Why can’t I access the file after 14 days?
A: Download links are valid for 14 days to ensure timely access. Once downloaded, you can save the file to your computer for unlimited viewing and printing. This system reduces bandwidth usage and ensures you can access the file offline at your convenience.
Force Majeure
- FITBODY shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, weather disruptions, labor strikes, pandemics, or interruptions in transportation services.
Disclaimer of Warranties and Limitation of Liability
FITBODY provides its products and services, including digital fitness programs, "as is" and "as available," without warranties of any kind, express or implied.
Nutritional Supplements
Nutritional supplements sold by FITBODY are manufactured by third-party companies. FITBODY relies on their representations regarding product safety, efficacy, and compliance with applicable laws and regulations. FITBODY does not manufacture or formulate these products and makes no warranties or representations regarding their suitability for any specific purpose.
The statements regarding these products have not been evaluated by the Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure, or prevent any disease. Consult your physician or healthcare provider before starting any new supplement regimen, especially if you are pregnant, nursing, taking medications, or have a medical condition.
Digital Fitness Programs
The fitness and nutrition advice provided through FITBODY’s digital programs, including workout plans, nutrition guidance, and educational materials, is intended for informational purposes only. Results may vary depending on individual circumstances, including health conditions, fitness levels, and compliance with the programs.
Before starting any new fitness or nutrition program, consult with your physician or a qualified health professional to determine if it is suitable for your specific needs. FITBODY is not liable for any injuries, health complications, or adverse outcomes resulting from participation in these programs.
FITBODY disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
FITBODY is not liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising from the use or inability to use our products or services. This includes but is not limited to adverse reactions, injuries, or other health-related issues.
By purchasing and using our products and services, you agree that FITBODY’s total liability, if any, shall not exceed the amount you paid for the product or service in question.
Typographical Errors
- In the event a product is listed at an incorrect price due to a typographical or system error, FITBODY reserves the right to refuse or cancel any orders placed at the incorrect price. If your payment has been processed, a refund will be issued immediately.
Changes to These Terms
- FITBODY reserves the right to modify these Terms of Service at any time. Changes will be posted on our website, and continued use of our services indicates acceptance of the revised terms.
SMS Messaging Terms & Conditions
By providing your mobile phone number and opting in to receive SMS messages from FITBODY, you consent to receive recurring automated promotional and transactional text messages related to your account, orders, promotions, reminders, and updates. Message frequency may vary.
Consent & Opt-In
- Consent to receive SMS messages is not a condition of purchase.
- You may opt in via website forms, checkout, keyword sign-ups, or other explicit consent methods.
- By opting in, you represent that you are the authorized user of the mobile number provided.
Opt-Out & Help
- You may opt out at any time by replying STOP to any SMS message.
- After opting out, you will receive a confirmation message and no further messages will be sent unless you re-subscribe.

- Message and data rates may apply depending on your mobile carrier and plan.
- FITBODY is not responsible for any charges incurred from SMS communications.

Privacy
- Your mobile number and SMS consent information are handled in accordance with our Privacy Policy.
- We do not sell or share SMS subscriber information with third parties for their marketing purposes.
Eligibility
- SMS services are available only to U.S. residents with a compatible mobile device and active wireless service.
Governing Law
- These Terms of Service are governed by the laws of the state of Kentucky. Any disputes arising from these terms or your use of our services will be resolved in the appropriate courts of Kentucky.
